Terms of Service
Last updated: October 19, 2026
These Terms of Service (the “Terms”) govern access to and use of the O Ecclesium platform, including the website o-ecclesium.com, the parish websites it hosts, the administration console and the related services (together, the “Service”). The Service is operated by O Ecclesium, a simplified joint-stock company (SAS) organized under the laws of France (“O Ecclesium”, “we”, “us”). By creating an account or using the Service, you agree to these Terms on your own behalf and on behalf of the parish or organization you represent (“you”, the “Parish”).
1. Who may use the Service
The Service is intended for Catholic parishes, missions, chaplaincies and similar religious organizations, and for the pastors, staff and volunteers they authorize. By opening an account you represent that you are at least 18 years old and that you have authority to bind the Parish to these Terms. The Service is not directed to children, and we do not knowingly allow anyone under 13 to create an account.
2. Description of the Service
O Ecclesium is a software-as-a-service platform that lets a Parish build and host its website, publish news and Mass schedules, send newsletters to subscribers, manage room and hall bookings, receive online donations and payments, run a members’ intranet and synchronize its calendar with third-party calendar services. The features available to you depend on the plan you subscribe to, as described on our pricing page. We may add, change or remove features over time; we will give reasonable notice of changes that materially reduce the functionality of a paid plan.
3. Accounts and security
- You must provide accurate and current information when you register and keep it up to date.
- You are responsible for safeguarding your credentials and for every activity that occurs under your account, including the actions of the administrators, staff and volunteers you invite. Notify us promptly at o-ecclesium@proton.me of any unauthorized use.
- Each account belongs to the Parish, not to the individual who created it. Where a Parish asks us to transfer control of an account to a new pastor or administrator, we may request reasonable proof of authority before doing so.
4. Plans, fees and payment
- Free plan. You may build and prepare your website free of charge, without time limit. Publishing the website and the other paid features require a paid subscription.
- Paid plans. Subscriptions are billed monthly in advance, in U.S. dollars for Parishes located in the United States, at the price shown on the pricing page when you subscribe. Prices are exclusive of any applicable sales or use taxes, which you are responsible for where they apply.
- Payment processing. Payments are processed by Stripe, Inc. (“Stripe”). We do not store your full card number. By subscribing you also agree to the Stripe terms that apply to you. Donations and payments collected from parishioners through your website are processed under the Parish’s own Stripe account; O Ecclesium does not hold those funds.
- Renewal and cancellation. Subscriptions renew automatically each month until canceled. You may cancel at any time from the administration console; cancellation takes effect at the end of the current billing period and fees already paid are not refunded, except where required by law.
- Price changes. We may change our prices with at least 30 days’ notice by e-mail or in the administration console. The new price applies from your next renewal after the notice period.
- Late or failed payment. If a payment fails, we may suspend the paid features (including publication of the website) after notifying you, until the balance is settled.
5. Your content
You retain all rights in the texts, images, documents, subscriber lists and other material you upload or publish through the Service (“Parish Content”). You grant O Ecclesium a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display and transmit Parish Content solely as necessary to provide, secure and improve the Service and to comply with the law. You are solely responsible for Parish Content, and you represent that you hold the rights needed to publish it (including photographs of identifiable people and copyrighted texts, music or images) and that it does not violate any law or third-party right.
Personal information about parishioners, subscribers and visitors that you collect through your website is your responsibility as the organization that decides why and how it is used. O Ecclesium processes it on your behalf and on your instructions, as described in our Privacy Policy.
6. Acceptable use
You agree not to use the Service to:
- send unsolicited bulk e-mail, or e-mail to people who have not agreed to receive it;
- publish content that is unlawful, defamatory, harassing, obscene or that infringes the rights of others;
- collect or process personal information without a lawful basis or beyond what people would reasonably expect;
- attempt to gain unauthorized access to the Service, other accounts or the systems of our providers;
- interfere with the Service, probe its security, or use it to distribute malware;
- resell or sublicense the Service, or use it for an organization other than the Parish named in the account without our consent.
7. E-mail and newsletters
Newsletters and transactional e-mails are sent through our e-mail provider on your behalf. You are responsible for complying with the laws that apply to your messages, including the CAN-SPAM Act in the United States: send only to people who signed up or otherwise agreed to hear from you, identify the Parish as the sender, and honor unsubscribe requests. The Service adds an unsubscribe link to every newsletter; do not remove it or circumvent it. We may limit sending volumes or suspend sending if your messages generate abnormal complaint or bounce rates.
8. Third-party services
Some features rely on services operated by third parties under their own terms: Stripe for payments, Google for calendar synchronization, and the hosting and e-mail providers listed in our Legal Notice. When you connect a third-party account (for example a Google Calendar), you authorize us to access it as needed for the feature you enabled, and you may revoke that access at any time from the administration console or from the third party’s own settings. We are not responsible for third-party services, their availability or their changes.
9. Intellectual property
The Service, including its software, design, templates, trademarks and documentation, is owned by O Ecclesium or its licensors and is protected by copyright, trademark and other laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for the Parish’s own purposes during your subscription. You may not copy, modify, reverse-engineer or create derivative works of the Service, except as permitted by law. Feedback and suggestions you send us may be used freely by O Ecclesium without obligation to you.
10. Availability, support and backups
We work to keep the Service available at all times but do not guarantee uninterrupted or error-free operation. Planned maintenance is announced whenever practicable. We back up the platform’s data daily; backups exist to restore the Service as a whole and are not a substitute for your own export of Parish Content, which you may download at any time. Support is provided by e-mail in English and French; response times depend on your plan.
11. Term, suspension and termination
- These Terms apply for as long as you have an account.
- You may close your account at any time from the administration console or by e-mail. We will then delete Parish Content within 90 days, except where we must keep it to comply with the law or to resolve disputes. You may export your content before closing the account.
- We may suspend or terminate your access, after notice where reasonably possible, if you materially breach these Terms, if your use creates a security or legal risk for the Service or for others, or if your subscription remains unpaid 30 days after a failed payment notice.
- We may discontinue the Service as a whole with at least 90 days’ notice, in which case we will refund any prepaid fees for the period after discontinuation.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, O ECCLESIUM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT DATA WILL NOT BE LOST. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, O ECCLESIUM AND ITS OFFICERS, EMPLOYEES AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, DONATIONS OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE FEES YOU PAID TO O ECCLESIUM IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100) IF YOU HAVE PAID NO FEES. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW.
14. Indemnification
You agree to defend, indemnify and hold harmless O Ecclesium from any claim, loss or expense (including reasonable attorneys’ fees) arising from Parish Content, from your use of the Service in violation of these Terms or of the law, or from the personal information you collect through your website.
15. Governing law and disputes
Governing law and venue to be confirmed by counsel. Unless otherwise agreed in writing, these Terms are governed by the laws of France, without regard to its conflict-of-law rules, and any dispute that cannot be resolved amicably will be submitted to the competent courts of Paris, France. Before bringing a claim, you agree to contact us at o-ecclesium@proton.me so that we can try to resolve the matter informally within 60 days. Nothing in this section prevents either party from seeking injunctive relief, or deprives you of mandatory protections under the laws of your state.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced at least 30 days in advance by e-mail or in the administration console; the date at the top of this page shows when the Terms were last revised. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms. If you do not agree, you may close your account before the change takes effect.
17. General
- These Terms, the Privacy Policy and your plan constitute the entire agreement between you and O Ecclesium about the Service.
- If any provision is held unenforceable, the remaining provisions remain in effect.
- Our failure to enforce a provision is not a waiver of our right to do so later.
- You may not assign these Terms without our consent; we may assign them to a successor of our business.
- Notices to you are sent to the e-mail address of the account; notices to us go to o-ecclesium@proton.me.
- The French Conditions Générales d'Utilisation apply to Parishes in France; this English version is the agreement for Parishes in the United States.
